Terms & Conditions
1. Scope
These terms govern the relationship between Atelier Barnard S.L. ("the atelier") and any client ("the client") commissioning bespoke jewellery, restoration or setting services. Acceptance of a written quotation from the atelier constitutes acceptance of these terms.
2. Commissions and quotations
All commissions are quoted individually in writing. Quotations are valid for thirty (30) days from the date of issue. Prices include workmanship and hallmarking but exclude shipping, insurance and any independent gemological certification unless explicitly included in the quotation.
3. Deposits and payment
Bespoke commissions require a non-refundable deposit of fifty percent (50%) of the quoted total before any design or sourcing work commences. The balance is payable before delivery. Restoration and setting-only services are quoted individually and may require a smaller deposit at the discretion of the atelier.
4. Client-supplied stones and metals
Where the client supplies stones or metals for incorporation into a commission, the atelier will inspect and document them on receipt. The atelier accepts no liability for pre-existing defects, undisclosed treatments or value discrepancies in client-supplied materials. The atelier reserves the right to decline to work with materials it considers unsuitable.
5. Timelines
Quoted timelines are estimates given in good faith. The atelier will keep the client informed of significant changes. Delays caused by stone sourcing, third-party certification or shipping are not grounds for cancellation of the commission.
6. Delivery and risk
Risk transfers to the client on collection at the atelier, or on receipt where the piece is shipped by insured courier. The atelier arranges shipping at the client's cost and insists on fully insured, signature-required transit for all completed pieces.
7. Limitation of liability
The atelier's liability is limited to the contracted value of the commission. The atelier is not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited under Spanish law.
8. Governing law
These terms are governed by Spanish law. Any disputes are subject to the exclusive jurisdiction of the courts of Palma de Mallorca.
